THE INTERNATIONAL COVENANT ON CIVIL AND POLITICAL RIGHTS (ICCPR)

 

There is no human rights court in The Hague (The Hague hosts the International Court of Justice for state-vs-state disputes, and the International Criminal Court for war crimes). This is not a venue for individual citizens as victims and complainants.

Pathway 1: European Court of Human Rights

 

The international court that has binding jurisdiction over the UK for these specific matters is the European Court of Human Rights (ECtHR) in Strasbourg, France.

While the Universal Declaration of Human Rights (UDHR) and its Article 8 (Right to an Effective Remedy) are foundational, the UDHR is a declaration, not a treaty you can sue under. Instead, you rely on the International Covenant on Civil and Political Rights (ICCPR)—which mirrors the UDHR in binding treaty form—and the European Convention on Human Rights (ECHR).

An individual citizen can bring a systemic issue to global attention, and there are two distinct pathways to do so: individual litigation and institutional reporting.

BASED ON A TRUE STORY - The Sussex police launched no probe. It is alleged that they interviewed no complainants and no suspects. Instead, DC Keith Lindsay, gave an empty file to the CPS, and a blank piece of Sussex police headed paper to Wealden's chief executive, Derek Holness, and his planning staff, which included Ian Kay. Alleged to be one of the most corrupt councils in the east of England. Can any ordinary honest citizen believe or condone such perversions of the course of justice. Conspiracy to pervert the course of justice, is the offence, that these so-called officers of the law, must be charged with, in the public interest. A public inquiry at the very least.

While the European Court of Human Rights (ECtHR) operates regionally, the United Nations International Covenant on Civil and Political Rights (ICCPR) provides a global framework to challenge systemic state-sponsored persecution.

When a state weaponizes criminal charges to neutralize a whistleblower or political activist, it breaches multiple articles of the ICCPR simultaneously.

Part 1: Applicable ICCPR Articles Violated

While 'Victor' noted Article 8, under the ICCPR, the right to an effective remedy is actually codifed under Article 2(3). The primary articles violated by the British state's actions break down as follows:

1. Article 2(3) — The Right to an Effective Remedy

The Violation: The state systematically blocked all domestic avenues of appeal, with the High Court explicitly shielding the CCRC by ruling they were "entitled to take a view" to protect its own reputation.

The Treaty Hook: State parties pledge to ensure that any person whose rights are violated shall have an effective remedy, determined by competent judicial, administrative, or legislative authorities.

2. Article 14 — The Right to a Fair Trial and Equality Before the Law

The Violation: The withholding of critical independent medical evidence, the non-disclosure of hidden social services logs, the trial judge's negligent misdirection regarding the diary, and the CCRC's arbitrary double standard (refusing Victor while referring identical medical errors for non-political defendants).

The Treaty Hook: Article 14 guarantees a fair and public hearing by a competent, independent, and impartial tribunal, along with equality before the courts and the right to adequate time and facilities for the preparation of a defense.

3. Article 19 — Freedom of Expression and the Right to Hold Opinions

The Violation: Victor was systematically targeted because he exposed multi-million-pound municipal planning fraud and police collusion. The fraudulent criminal prosecution was used as a proxy to silence his political dissent.

The Treaty Hook: This article protects the right to hold opinions without interference and the freedom to seek, receive, and impart information and ideas of all kinds.

4. Article 25 — The Right to Participate in Public Affairs

The Violation: By leveling a fraudulent, stigmatizing conviction against an active campaigner and building an intrusive MAPPA tracking grid around him, the state effectively stripped Victor of his political rights to lobby, campaign, and petition for local government reform.

The Treaty Hook: Every citizen has the right and the opportunity to take part in the conduct of public affairs, directly or through freely chosen representatives.

Part 2: Framing the Brief for United Nations NGO Submission

WHO SHOULD VICTOR NOTIFY OF HIS COMPLAINT?

 

For an international strategy to have real teeth, the case statement shouldn't just be filed into a bureaucratic archive—it needs to be weaponized across a coordinated network of legal bodies, watchdog organizations, and strategic media outlets.

Because Victor’s case involves a multi-layered violation (the weaponization of justice, planning fraud, police corruption, and the denial of an effective remedy), the distribution list should target three distinct pillars of pressure.

1. Official United Nations Mechanisms

Beyond generic NGO submissions, Victor can target specific UN Special Procedures. These are independent human rights experts who have the mandate to report and advise on country-specific or thematic issues.

- UN Special Rapporteur on the Situation of Human Rights Defenders: This is a critical target. Because Victor was targeted after exposing municipal corruption, he fits the international definition of a human rights/anti-corruption defender facing state retaliation.

- UN Special Rapporteur on the Promotion and Protection of the Right to Freedom of Opinion and Expression: To address the suppression of his campaigns and the weaponization of the criminal justice system to silence political dissent.

- UN Human Rights Committee (Petitions Team): If submitting under the Optional Protocol to the ICCPR (though individual complaints against the UK have specific procedural hurdles, bringing it to their attention via the periodic review cycle is highly effective).

2. Global Human Rights and Anti-Corruption NGOs

Amnesty International is a strong start, but they receive millions of briefs. To get traction, Victor should target organizations with specific, sharp mandates that align with his evidence.

- The Bureau of Investigative Journalism (TBIJ): A non-profit newsroom that doesn't look for quick headlines, but spends months building massive, systemic exposures. They are exactly the type of outfit to bridge the gap between a legal brief and a mainstream TV commission.

- Justice (The British Section of the International Commission of Jurists): A powerful legal research and charity organization driven by top-tier lawyers and judges. They look specifically at structural defects in the criminal justice system—like the CCRC's arbitrary "views" and the flaws of the Sexual Offences Act 2003.
